Статья посвящена конституционно-правовому анализу института федеральных территорий в зарубежных странах. На основе сравнительно-правового исследования учредительных актов ряда федеративных государств (Австралия, Аргентина, Бельгия, Бразилия, Венесуэла, Индия, Малайзия, Мексика, Пакистан, США) автором формулируются универсальные и специализированные конституционные принципы создания таких территориальных единиц. Делается вывод об отсутствии данных принципов в отечественном конституционном праве. В целях уточнения представления о сущности и природе введенного в отечественное конституционное право института федеральных территорий, а также устранения существующих проблем и недостатков правового регулирования общественных отношений, возникающих в процессе их создания и функционирования, констатируется необходимость имплементации установленных в рамках сравнительно-правового исследования конституционных принципов в российское законодательство.

The article is devoted to a constitutional and legal analysis of the institution of federal territories in foreign countries. Based on a comparative legal study of the founding acts of a number of federal states (Australia, Argentina, Belgium, Brazil, Venezuela, India, Malaysia, Mexico, Pakistan, the USA), the author formulates universal and specialized constitutional principles for the creation of such territorial units. The conclusion is drawn that these principles are absent in domestic constitutional law. In order to clarify the understanding of the essence and nature of the institution of federal territories, which has been introduced into domestic constitutional law, as well as to address the existing problems and shortcomings in the legal regulation of social relations arising in the process of their creation and operation, it is necessary to implement the constitutional principles established within the framework of a comparative-legal study into Russian legislation.
