<p>The article examines the place of the smart contract among the civil‑law means of forming a digital trust environment in business relations. The methodology includes formal legal interpretation of part two of Article 309 of the Civil Code of the Russian Federation and of the rules on the form of transactions, systemic analysis of the relationship between the smart contract, the contract as such and the methods of securing performance of obligations, and comparative legal analysis. The study shows that the smart contract changes the very configuration of trust in commerce. The expectation of proper conduct by the counterparty is replaced by reliance on automatic performance embedded in the program code, so that trust shifts from the person of the debtor towards the technology and those responsible for its correct operation. This shift does not eliminate the need for civil‑law means but alters their composition. Particular importance is acquired by terms governing automatic performance, representations of facts, allocation of failure risks and liability for defects in the program code. Proposals are formulated concerning contractual mechanisms protecting the bona fide party and the limits of automatic performance in business circulation.</p>
<kwd-group xml:lang="en"><kwd>smart contract</kwd><kwd>digital trust environment</kwd><kwd>self-execution</kwd><kwd>performance of obligation</kwd><kwd>business circulation</kwd><kwd>program code</kwd><kwd>risk allocation</kwd><kwd>civil‑law means</kwd></kwd-group><kwd-group xml:lang="ru"><kwd>смарт-контракт</kwd><kwd>цифровая среда доверия</kwd><kwd>самоисполнимость</kwd><kwd>исполнение обязательства</kwd><kwd>предпринимательский оборот</kwd><kwd>программный код</kwd><kwd>распределение рисков</kwd><kwd>гражданско-правовые средства</kwd></kwd-group></article-meta></front><back><ref-list><ref id="ref1"><mixed-citation publication-type="other" xml:lang="ru">[1] Валеев Д. Г. – 2022. – № 3. – С. 37–40.</mixed-citation></ref><ref id="ref2"><mixed-citation publication-type="other" xml:lang="ru">[2] Волос А.А. – 2018. – № 12. – С. 5–7.</mixed-citation></ref><ref id="ref3"><mixed-citation publication-type="other" xml:lang="ru">[3] Ворникова Е.Д. – 1994. – № 32. – Ст. 3301.</mixed-citation></ref><ref id="ref5"><mixed-citation publication-type="other" xml:lang="ru">[5] Гринь О. В. – 2019. – № 8. – С. 51–62.</mixed-citation></ref><ref id="ref6"><mixed-citation publication-type="other" xml:lang="ru">[6] Ефимова Л. Б. – 2019. – № 1. – С. 23–30.</mixed-citation></ref><ref id="ref7"><mixed-citation publication-type="other" xml:lang="ru">[7] Михайлов А.В. – 2023. – № 4. – С. 2–9.</mixed-citation></ref><ref id="ref8"><mixed-citation publication-type="other" xml:lang="ru">[8] Новоселова Л. – 2017. – № 12. – С. 29–44.</mixed-citation></ref><ref id="ref9"><mixed-citation publication-type="other" xml:lang="ru">[9] Савельев А.И. – 2016. – № 3. – С. 32–60.</mixed-citation></ref><ref id="ref10"><mixed-citation publication-type="other" xml:lang="ru">[10] Савельев А.И. – 2017. – № 5. – С. 94–117.</mixed-citation></ref><ref id="ref11"><mixed-citation publication-type="other" xml:lang="ru">[11] Ситдикова Р. Б.
