<p>The relevance of the study is due to the transformation of the institution of civil liability in the context of digitalization and the introduction of artificial intelligence technologies, as well as the need to gradually shift civil law regulation from the traditional model based on the principle of fault to risk-based approaches. The subject of the study is social relations arising in connection with causing harm through the use of artificial intelligence (AI) technologies, specifically the problems of distributing civil liability between the developer, operator, and user of AI systems. The aim of the study is to identify the main problems of legal regulation, taking into account the legislation, the existing law enforcement practice, and foreign experience, as well as to propose ways to improve it. The methodological basis includes a set of cognitive methods: the dialectical method, the method of analysis and synthesis, the method of system approach, the formal-legal method, the comparative legal method, and the modeling method. The scientific novelty of the work lies in substantiating the criterion of predictability of algorithmic behavior as a key factor in differentiating civil liability for harm caused by AI, and in developing the author’s version of Article 1064.1 of the Civil Code of the Russian Federation, which establishes differentiated liability for the developer, operator, and user of an AI system depending on the level of risk, the degree of predictability of the system’s behavior, and the actual control over the algorithm. These proposals are specific and practically implementable.</p>
<kwd-group xml:lang="en"><kwd>civil liability</kwd><kwd>tort</kwd><kwd>artificial intelligence</kwd><kwd>fault</kwd><kwd>risk</kwd><kwd>predictability</kwd><kwd>source of increased danger</kwd><kwd>developer of an AI system</kwd><kwd>operator of an AI system</kwd><kwd>user of an AI system</kwd></kwd-group><kwd-group xml:lang="ru"><kwd>гражданско-правовая ответственность</kwd><kwd>деликт</kwd><kwd>искусственный интеллект</kwd><kwd>вина</kwd><kwd>риск</kwd><kwd>предсказуемость</kwd><kwd>источник повышенной опасности</kwd><kwd>разработчик ИИ‑системы</kwd><kwd>оператор ИИ‑системы</kwd><kwd>пользователь ИИ‑системы</kwd></kwd-group></article-meta></front><back><ref-list><ref id="ref1"><mixed-citation publication-type="other" xml:lang="ru">[1] Лапшин В. В.
