<p>The article examines the procedural and substantive legal mechanisms for protecting the rights of participants in legal proceedings from poor-quality forensic examination. In addition to the traditionally identified direct costs (the cost of the examination), the justification is provided for the allocation of “indirect procedural losses” — expenses for review, notarization of evidence, and legal support for petitions — which are subject to recovery under the rules on reimbursement of court costs (Article 98 of the Civil Procedure Code of the Russian Federation, Article 110 of the Arbitration Procedure Code of the Russian Federation). Furthermore, in order to improve the legislation, specific amendments have been proposed to Article 18 of Federal Law No. 73-FZ, aimed at introducing a mechanism for an unconditional refund of funds if the conclusion is deemed inadmissible as evidence. Based on an analysis of the provisions of the current legislation and relevant judicial practice, the authors systematize the grounds for recovering legal costs and holding experts liable for various types of responsibility. Special attention is paid to the issue of reimbursement of expenses incurred for the payment of studies whose conclusions are deemed inadmissible or scientifically unfounded. The conclusion is substantiated that effective mechanisms for challenging and obtaining financial compensation are necessary to ensure a balance of interests between the parties, maintain the quality standards of expert activities, and protect citizens’ rights from procedural abuses.</p>
<kwd-group xml:lang="en"><kwd>forensic examination</kwd><kwd>substandard examination</kwd><kwd>expert errors</kwd><kwd>review</kwd><kwd>challenging an expert’s conclusion</kwd><kwd>legal costs</kwd><kwd>compensation for damages</kwd><kwd>allocation of legal expenses</kwd><kwd>expert liability</kwd><kwd>adversarial principle</kwd><kwd>indirect procedural losses</kwd></kwd-group><kwd-group xml:lang="ru"><kwd>судебная экспертиза</kwd><kwd>недоброкачественная экспертиза</kwd><kwd>экспертные ошибки</kwd><kwd>рецензия</kwd><kwd>оспаривание заключения эксперта</kwd><kwd>судебные издержки</kwd><kwd>возмещение убытков</kwd><kwd>распределение судебных расходов</kwd><kwd>ответственность эксперта</kwd><kwd>принцип состязательности</kwd><kwd>косвенные процессуальные убытки</kwd></kwd-group></article-meta></front><back><ref-list><ref id="ref1"><mixed-citation publication-type="other" xml:lang="ru">[1] Бурматова О. П. — 2020. — № 4. — С. 112–118.</mixed-citation></ref><ref id="ref2"><mixed-citation publication-type="other" xml:lang="ru">[2] Галяшина Е. И. И. Р. — 320 с.</mixed-citation></ref><ref id="ref3"><mixed-citation publication-type="other" xml:lang="ru">[3] Гасанов Н. В. — 2025. — № 3. — С. 56–61.</mixed-citation></ref><ref id="ref4"><mixed-citation publication-type="other" xml:lang="ru">[4] Моисеева Т. Ф.
