В статье исследуется история возникновения и развития Московской биржи как института представительства предпринимательства Российской империи. Автор анализирует эволюцию правовых обычаев и законодательных инициатив, начиная с указа Петра I 1703 года и до принятия Устава Московской биржи 1870 года. Особое внимание уделяется созданию Московского биржевого комитета в 1839 году, его полномочиям, включая квазисудебные функции по делам о несостоятельности, регулированию деятельности биржевых маклеров и артелей. Показано, что биржа выполняла функции торгово-промышленной палаты, а её правовой статус окончательно закрепился в Уставе 1870 года, предоставившем биржевому обществу права юридического лица. Рассматриваются прецеденты Правительствующего Сената, укрепившие юрисдикцию биржевых комитетов. Делается вывод о сочетании купеческого самоуправления и государственного надзора, а также о ценности исторического опыта для современного регулирования биржевой деятельности.

The article examines the history of the emergence and development of the Moscow Stock Exchange as an institution representing entrepreneurship in the Russian Empire. The author analyzes the evolution of legal customs and legislative initiatives, starting with Peter I’s decree of 1703 and ending with the adoption of the Charter of the Moscow Exchange in 1870. Special attention is paid to the establishment of the Moscow Exchange Committee in 1839, its powers, including quasi-judicial functions in insolvency cases, and the regulation of the activities of stockbrokers and artels. It is shown that the exchange performed the functions of a chamber of commerce and industry, and its legal status was finally consolidated in the Charter of 1870, which granted the exchange society the rights of a legal entity. The precedents of the Governing Senate, which strengthened the jurisdiction of exchange committees, are examined. The conclusion is drawn about the combination of merchant self-government and state supervision, as well as about the value of historical experience for the modern regulation of exchange activities.
