<p>The article examines the criterion of creative character as a condition for the protectability of a photographic work within the system of exclusive rights. With the shift to digital technologies, photography has become one of the most widespread results of creative activity, which has confronted the law with the task of distinguishing a technical result of the recording of reality from a protected object of copyright. To compare the content of this criterion, the article analyses the Russian, German, French and English models for its establishment, which differ from one another in mechanism while displaying considerable similarity at the substantive level. The analysis carried out has made it possible to identify both features of a photographer's creative contribution common to the legal systems examined and the specific character of the Russian model, which gravitates towards a subjective, activity-based understanding of creativity. The relevance of the topic lies in examining the content of this criterion as applied to the photographic work and its significance for law enforcement practice.</p>
<kwd-group xml:lang="en"><kwd>exclusive rights</kwd><kwd>photographic work</kwd><kwd>copyright</kwd><kwd>creative character</kwd><kwd>protectability</kwd><kwd>originality</kwd><kwd>intellectual activity</kwd><kwd>threshold of protectability</kwd></kwd-group><kwd-group xml:lang="ru"><kwd>исключительные права</kwd><kwd>фотографическое произведение</kwd><kwd>авторское право</kwd><kwd>творческий характер</kwd><kwd>охраноспособность</kwd><kwd>оригинальность</kwd><kwd>интеллектуальная деятельность</kwd><kwd>порог охраноспособности</kwd></kwd-group></article-meta></front><back><ref-list><ref id="ref1"><mixed-citation publication-type="other" xml:lang="ru">[1] Серебровский В.И.
