Актуальность исследования обусловлена научными и практическими задачами развития современного местного самоуправления. В статье проводится сравнительный анализ развития законодательных установлений о субъектах компетенционных правовоотношений в местном самоуправлении, раскрывается роль муниципальных образований в реализации компетенции местного самоуправления в различные периоды его становления в нашей стране, исследуется субъектность населения, органов и должностных лиц местного самоуправления в системе муниципальных компетенционных правоотношений. Осуществляемое в нашей стране в последние годы систематическое обновление законодательства о местном самоуправлении позволяет выявить общую тенденцию к отнесению наиболее важных компетенций к ведению муниципальных образований, а роль самоуправляющегося населения и органов местного самоуправления как бы вторична. Новый Федеральный закон от 20 марта 2025 г. № 33-ФЗ «Об общих принципах организации местного самоуправления в единой системе публичной власти» определил муниципальное образование в качестве публично-правового образования, что актуализирует необходимость анализа его сущности и компетенционных возможностей в условиях функционирования единой системы публичной власти. В статье акцентируется внимание на дальнейшем совершенствовании правовых основ муниципальной компетенции, необходимости расширения различных форм вовлечения граждан в решение вопросов непосредственного обеспечения жизнедеятельности населения.

The relevance of the study is due to the scientific and practical tasks of the development of modern local self-government. The article conducts a comparative analysis of the development of legislative provisions on the subjects of competence legal relations in local self-government, reveals the role of municipalities in the implementation of the competence of local self-government in different periods of its formation in our country, studies the subjectivity of the population, bodies and officials of local self-government in the system of municipal competence legal relations. The systematic updating of the legislation on local self-government in our country in recent years makes it possible to identify a general trend towards the attribution of the most important competencies of the municipal level to municipalities, and not to the self-governing population and local self-government bodies. The new Federal Law of March 20, 2025 No 33-FZ "On the General Principles of the Organization of Local Self-Government in a Unified System of Public Authority" defined a municipality as a public legal entity, which actualizes the need to analyze its essence and competence capabilities in the context of the functioning of a unified system of public authority. The article focuses on the further improvement of the legal framework of municipal competence, the need to expand various forms of involvement of citizens in solving issues of direct support of the population.
