<p>The article examines state control and supervision in higher education as an element of the public‑law mechanism for implementing the constitutional right to education. The author argues that educational control should not be reduced to a formal verification of mandatory requirements by educational organizations. Its public purpose also includes ensuring actual accessibility and appropriate quality of education, protecting students’ rights and preventing violations capable of obstructing the exercise of the right to education. The article analyzes the Constitution of the Russian Federation, Federal Law No. 273-FZ “On Education in the Russian Federation”, Federal Law No. 248-FZ “On State Control (Supervision) and Municipal Control in the Russian Federation”, and the current Regulation on federal state control (supervision) in education. Licensing, state accreditation, control measures, preventive measures and legal consequences of violations are considered. Particular attention is paid to higher education and to the need to assess control procedures from the perspective of preserving students’ educational rights. Directions for improving control are proposed, including strengthening its rights-protective orientation, taking digital forms of educational activity into account, and establishing procedures for restoring violated rights.</p>
<kwd-group xml:lang="en"><kwd>right to education</kwd><kwd>higher education</kwd><kwd>state control</kwd><kwd>state supervision</kwd><kwd>educational activity</kwd><kwd>Rosobrnadzor</kwd><kwd>state accreditation</kwd><kwd>licensing</kwd><kwd>students’ rights</kwd><kwd>quality of education</kwd><kwd>public‑law mechanism</kwd><kwd>digitalization of education</kwd></kwd-group><kwd-group xml:lang="ru"><kwd>право на образование</kwd><kwd>высшее образование</kwd><kwd>государственный контроль</kwd><kwd>государственный надзор</kwd><kwd>образовательная деятельность</kwd><kwd>Рособрнадзор</kwd><kwd>государственная аккредитация</kwd><kwd>лицензирование</kwd><kwd>права обучающихся</kwd><kwd>качество образования</kwd><kwd>публично-правовой механизм</kwd><kwd>цифровизация образования</kwd></kwd-group></article-meta></front><back><ref-list><ref id="ref1"><mixed-citation publication-type="other" xml:lang="ru">[1] Конституция Российской Федерации: принята всенародным голосованием 12 декабря 1993 г. – 1993. – 25 дек.</mixed-citation></ref><ref id="ref2"><mixed-citation publication-type="other" xml:lang="ru">[2] Федеральный закон от 29 декабря 2012 г. – 2012. – № 53 (ч.
