В статье исследуется процесс генезиса прав человека в условиях перехода к парадигме «цифрового пространства 2.0» (по состоянию на 2026 год). На основе теоретических положений Т.Ю. Алферовой анализируется мутация классических свобод. Раскрывается сущность цифрового конституционализма. Проводится комплексный обзор дискурса зарубежных ученых (Дж. Балкина, Ш. Зубофф, Л. Флориди, П. Валке), выявляя ключевые западные концепции защиты цифровых прав. На основе сравнительно-правового анализа и доклада Совета при Президенте РФ по развитию гражданского общества и правам человека «Цифровая трансформация и защита прав граждан в цифровом пространстве 2.0» формулируется специфика отечественной модели, направленной на баланс между цифровым суверенитетом, технологическим развитием и защитой человеческого достоинства.

This article examines the genesis of human rights during the transition to a "digital space 2.0" paradigm (as of 2026). Drawing on the theoretical framework of T.Yu. Alferova, the study analyzes the mutation of classical freedoms and explores the essence of digital constitutionalism. It provides a comprehensive overview of the discourse among international scholars (J. Balkin, S. Zuboff, L. Floridi, P. Valcke), identifying key Western concepts regarding the protection of digital rights. Based on a comparative legal analysis and the report by the Presidential Council for Civil Society and Human Rights of the Russian Federation titled "Digital Transformation and the Protection of Citizens' Rights in the Digital Space 2.0," this paper outlines the specific features of the Russian model, which seeks to strike a balance between digital sovereignty, technological development, and the protection of human dignity.
