Выделены три этапа российской модели: попечительно-нравственный в имперский период, трудоцентристский в советское время и правозащитно-ресоциализационный после принятия Конституции Российской Федерации и Уголовно-исполнительного кодекса Российской Федерации. Показано, что современное регулирование сохраняет двойственную конструкцию: образование одновременно признаётся правом осуждённого и средством его исправления, вследствие чего доступность обучения зависит от режима учреждения, межведомственного взаимодействия и цифровой инфраструктуры. Германский опыт характеризуется земельной вариативностью, ориентацией на общественно признанные квалификации и защищённые электронные платформы; финский — принципом нормальности, привлечением внешних образовательных организаций и нейтральностью выдаваемых документов; французский — устойчивой кооперацией пенитенциарной администрации и системы национального образования, индивидуальной диагностикой и приоритетом обучения несовершеннолетних. Обоснована модель образовательной непрерывности, включающая индивидуальный маршрут, переносимость результатов при переводе и освобождении, внешнее качество программ, цифровую грамотность и оценку результата по завершённым квалификациям, а не по числу воспитательных мероприятий. Сформулированы предложения по разграничению полномочий администрации, образовательной организации и службы пробации.</p></abstract><abstract xml:lang="en" abstract-type="summary"><p>Annoatation. The article examines the historical and legal evolution of education and correctional upbringing for persons deprived of liberty in Russia and compares contemporary approaches in Germany, Finland and France. Three stages of the Russian model are identified: the charitable and moral stage of the imperial period, the labour-centred Soviet stage and the rights-based resocialisation stage formed after the adoption of the Constitution and the Penal Enforcement Code of the Russian Federation. Current regulation retains a dual construction: education is both a prisoner’s right and a means of correction, so practical access depends on the security regime, inter-agency cooperation and digital infrastructure. Germany combines regional diversity, publicly recognised qualifications and secure electronic platforms; Finland applies the principle of normality, relies on external education providers and issues neutral certificates; France maintains stable cooperation between the prison administration and the national education system, individual assessment and priority schooling for juveniles.
