Цель — определить предмет проверки решений, на содержание которых существенно повлияла автоматизированная обработка данных. Использованы формально-юридический, сравнительно-правовой и системно-структурный методы, анализ судебной практики. Сопоставлены российские дела о распознавании лиц и зарубежные решения, включая IOB 2025 г., CaseMatcher и дело Томпсона и Карло 2026 г. Предложены понятие алгоритмически обусловленного публично-властного решения и восьмиэлементный стандарт его судебной проверки. Разграничены контроль общих условий применения технологии и проверка индивидуального решения. Обоснована конкретизация обязанности публичного органа доказывать законность решения. Категории технологического усмотрения и технологического делегирования раскрывают значение настройки системы и участия частного разработчика без передачи публичной компетенции.</p></abstract><abstract xml:lang="en" abstract-type="summary"><p>The article examines judicial review of artificial intelligence and other algorithmic systems in public administration. It aims to define the scope of review where automated data processing substantially influences a public-authority decision. The study uses formal legal, comparative legal and systemic structural methods and case‑law analysis. Russian facial recognition cases are compared with foreign judgments, including IOB (2025), CaseMatcher and Thompson and Carlo (2026). The article proposes the concept of an algorithmically conditioned public-authority decision and an eight-element framework for its judicial review. Review of the general conditions governing technology use is distinguished from review of an individual decision. The study specifies how the public authority’s existing burden of proving lawfulness applies to algorithmic participation.
