Распространение кредитования физических лиц и увеличение числа невозвращаемых кредитов заставило принять нормы о несостоятельности и в сфере непредпринимательских отношений. В настоящее время Федеральным законом «О несостоятельности (банкротстве)» регулируется процедура банкротства, как юридических, так к физических лиц. Однако банкротство физических лиц в России имеет достаточно длительную историю и впервые было закреплено еще в нормативных актах Древнерусского государства. В статье анализируется эволюция правовых норм средневекового русского права, регулировавших несостоятельность (банкротство) должников на протяжении XI – XIII вв. Проведенное исследование позволило автору сделать вывод о ранней дифференциации процедуры банкротства в отношении разных категорий несостоятельных должников – физических лиц и лиц, занимающихся предпринимательской (коммерческой) деятельностью. Банкротство физических лиц стало отражением процесса развития феодальных отношений и формирования различных категорий зависимого населения Руси, а банкротство купцов – развития торговли, в первую очередь международной. В нормах, регулирующих банкротство, в частности в тех положениях, которые предоставляли иностранным купцам преимущество перед отечественными при получении возмещения от должников, также прослеживается заинтересованность государства в устойчивых внешнеторговых отношениях.</p></abstract><abstract xml:lang="en" abstract-type="summary"><p>The bankruptcy procedure, as a tool for improving the economic situation of entities engaged in property transactions in the modern Russian Federation, has for a long time been applicable exclusively to legal entities and individual entrepreneurs, but with the development of market relations, situations have increasingly arisen in which individuals — citizens who are not entrepreneurs — have become unable to fulfill their monetary obligations. The spread of lending to individuals and the increase in the number of non repayable loans have necessitated the adoption of insolvency rules in the sphere of non entrepreneurial relations as well. Currently, the Federal Law «On Insolvency (Bankruptcy)» regulates the bankruptcy procedure for both legal entities and individuals. However, the bankruptcy of individuals in Russia has a rather long history and was first enshrined in the regulatory acts of the Ancient Russian state. The article analyzes the evolution of the legal norms of medieval Russian law that regulated the insolvency (bankruptcy) of debtors during the 11th–13th centuries. The study allowed the author to conclude that there was an early differentiation of the bankruptcy procedure in relation to different categories of insolvent debtors — individuals and persons engaged in entrepreneurial (commercial) activities. The bankruptcy of individuals reflected the process of the development of feudal relations and the formation of various categories of dependent population in Rus’, while the bankruptcy of merchants reflected the development of trade, primarily international trade.
