В статье проводится сравнительно-правовой анализ солидарности как принципа права двух региональных интеграционных объединений – Евразийского экономического союза (ЕАЭС) и Европейского Союза (ЕС). Обосновывается гипотеза о существовании двух моделей нормативного закрепления солидарности: имплицитной, свойственной ЕАЭС, где сам термин в учредительном Договоре ЕАЭС не получает содержательных ориентиров, хотя реализуется через деятельность органов ЕАЭС, и эксплицитной, характерной для ЕС, где солидарность закреплена одновременно как ценность, цель и отраслевой руководящий принцип. При этом как ЕС, так и ЕАЭС являются интеграционными образованиями с элементами наднациональности, располагают собственными судебными органами, формирующими автономный правопорядок, и ставят целью создание единого рынка со свободой перемещения товаров, лиц, услуг и капиталов. Однако, в вопросе о солидарности их правовые системы демонстрируют противоположность. В настоящее время большая часть выводов Суда ЕАЭС остается рекомендательной, в то время как на уровне ЕС выработаны конкретные векторы её последующего унифицирующего развития по отношению к государствам-членам. В ходе исследования использовались всеобщий диалектический метод познания, а также общенаучные, так и частнонаучные методы, включая системный, формально-юридический, анализ, синтез, индукция, дедукция и др. На материале учредительных договоров ЕС и ЕАЭС, практики судов названных объединений, а также практики национальных конституционных судов показано, что различие моделей договорного закрепления принципа социальной солидарности объясняется механизмами функционирования интеграции и ЕАЭС, а также степенью интеграции государств-членов.

This article provides a comparative legal analysis of solidarity as a legal principle in two regional integration associations – the Eurasian Economic Union (EAEU) and the European Union (EU). It hypothesizes the existence of two models of normative solidarity: an implicit model, characteristic of the EAEU, where the term itself is not substantively defined in the founding Treaty, although it is implemented through the activities of EAEU bodies; and an explicit model, characteristic of the EU, where solidarity is enshrined simultaneously as a value, a goal, and a sectoral guiding principle. Both the EU and the EAEU are integration entities with elements of supranationalism, possessing their own judicial bodies that form an autonomous legal order, and aiming to create a single market with the free movement of goods, persons, services, and capital. However, when it comes to solidarity, their legal systems exhibit almost mirror-image contrasts. Currently, the majority of the EAEU Court's findings remain advisory, while at the EU level, specific vectors for its subsequent unifying development in relation to member states have been developed. The study employed the universal dialectical method of cognition, as well as general scientific and specific scientific methods, including the systematic method, the formal-legal method, analysis, synthesis, induction, deduction, and others. Based on the founding treaties of the EU and EAEU, the practice of the courts of these associations, and the practice of national constitutional courts, it is shown that the differences in the models for the contractual enshrinement of the principle of social solidarity are explained by the mechanisms of integration and the EAEU, as well as the degree of integration of member states.
