<p>The article examines the role of forensic psychiatric examination at the stage of preliminary investigation in criminal proceedings. The study focuses on its importance for establishing legally relevant circumstances, assessing the sanity of a suspect or accused person, determining the person’s ability to independently defend his or her rights and legitimate interests, and resolving the issue of possible application of compulsory medical measures. Special attention is paid to the procedural order of appointing an examination, the content of the investigator’s decision, the formulation of questions to the expert and the evaluation of the expert opinion within the system of evidence. The article substantiates the conclusion that forensic psychiatric examination at the pre-trial stage should not be considered a merely auxiliary technical procedure. Its results may significantly affect the direction of investigation, the scope of proof, the limits of criminal liability and procedural guarantees of the participants. At the same time, the effectiveness of the examination depends not only on the professional competence of experts, but also on the quality of the investigator’s procedural work: timely appointment of the examination, completeness of the submitted materials, correctness of questions and proper reasoning of procedural decisions. The author identifies the main problems of law enforcement practice: late appointment of forensic psychiatric examination, formal reasoning in the investigator’s decision, formulation of legal questions addressed to experts, insufficient protection of the rights of the defence, and insufficiently motivated evaluation of expert opinions. It is proposed to consider forensic psychiatric examination as a complex criminal procedural instrument combining evidentiary, guarantee and human rights functions.</p>
<kwd-group xml:lang="en"><kwd>forensic psychiatric examination</kwd><kwd>preliminary investigation</kwd><kwd>criminal proceedings</kwd><kwd>sanity</kwd><kwd>insanity</kwd><kwd>evidence</kwd><kwd>expert opinion</kwd><kwd>compulsory medical measures</kwd><kwd>rights of the accused</kwd><kwd>investigator</kwd></kwd-group><kwd-group xml:lang="ru"><kwd>судебно-психиатрическая экспертиза</kwd><kwd>предварительное расследование</kwd><kwd>уголовное судопроизводство</kwd><kwd>вменяемость</kwd><kwd>невменяемость</kwd><kwd>доказательства</kwd><kwd>заключение эксперта</kwd><kwd>принудительные меры медицинского характера</kwd><kwd>права обвиняемого</kwd><kwd>следователь</kwd></kwd-group></article-meta></front><back><ref-list><ref id="ref1"><mixed-citation publication-type="other" xml:lang="ru">Уголовно-процессуальный кодекс Российской Федерации от 18.12.2001 № 174- ФЗ // Собрание законодательства Российской Федерации. 2001. № 52, ч.
