Авторы раскрывает историческую обусловленность сохранения в Остзейских губерниях обособленного правового порядка, сложившегося под влиянием шведского, польского и немецкого правового наследия, а также особенностей сословной организации местного дворянства и городского самоуправления.
Центральное место в представленном исследовании занимает анализ процессов систематизации остзейского права в XIX веке — в частности, разработки и издания Свода местных узаконений губерний Остзейских, который стал ключевым инструментом упорядочения разнородных источников партикулярного права. Показано, как систематизация служила одновременно средством фиксации местных правовых традиций и каналом постепенной унификации регионального правопорядка с общеимперскими правовыми стандартами.
Особое внимание уделено соотношению партикулярных норм и общеимперского законодательства, механизмам согласования коллизий и практике применения местных узаконений в судах. В статье используются архивные и опубликованные источники, труды дореволюционных правоведов (в том числе Л.А. Кассо, Б.Э. Нольде), а также нормативные акты имперского периода.
Представленное исследование вносит вклад в изучение истории российского права, демонстрируя на примере Остзейского края сложный баланс между сохранением региональной правовой самобытности и тенденциями централизации и унификации в многосоставном государстве. Результаты исследования могут быть использованы для дальнейшего исследования эволюции федеративных и децентрализованных правовых моделей, а также механизмов интеграции локальных правовых систем в единое правовое пространство.</p></abstract><abstract xml:lang="en" abstract-type="summary"><p>This article examines the specifics of Baltic (Ostsee) particular law as a distinct segment of local legal regulation within the legal system of the Russian Empire. The authors explore the historical rationale for the preservation of a distinct legal order in the Baltic provinces, influenced by Swedish, Polish, and German legal legacies, as well as the particularities of the class organization of the local nobility and municipal self-government.
A central focus of this study is an analysis of the processes of systematization of Baltic law in the 19th century—in particular, the development and publication of the Code of Local Laws of the Baltic Provinces, which became a key instrument for organizing the diverse sources of particular law. It demonstrates how this systematization served both as a means of documenting local legal traditions and as a channel for the gradual unification of regional legal systems with imperial legal standards. Particular attention is paid to the relationship between particular norms and imperial legislation, mechanisms for reconciling conflicts of law, and the application of local laws in court. The article draws on archival and published sources, the works of pre‑revolutionary legal scholars (including L.A. Kasso and B.E. Nolde), and regulatory acts from the imperial period.
This study contributes to the study of the history of Russian law by demonstrating, using the example of the Baltic region, the complex balance between the preservation of regional legal distinctiveness and trends toward centralization and unification in a multi-state.
