Цель исследования — концептуализировать феномен аномии как структурного свойства европейской интеграции, выявив его доктринальные истоки и институциональные проявления. Методологическую основу работы составляют формально-юридический анализ (изучение прецедентов Суда ЕС, актов конституционных судов государств-членов) и системно-функциональный подход, позволяющий оценить ЕС как гибридное правовое образование. В статье показано, что решения Суда ЕС (Van Gend en Loos, Costa v. ENEL) заложили основы правовой аномии, а ответная реакция национальных конституционных судов (Германия, Польша, Чехия, Италия) превратила её в полноценный кризис легитимности. На примере экономических потрясений, миграционного кризиса, пандемии COVID-19, цифровой трансформации и Брекзита демонстрируется, как нормативная неопределённость становится способом «правления через исключения». Научная новизна состоит в обосновании концепции «юридической аномии» как интегрирующей характеристики современного правопорядка ЕС, отражающей системный конфликт между наднациональным регулированием и конституционными суверенитетами. Практическая значимость выводов заключается в возможности их использования для оценки перспектив конституционных реформ в странах-кандидатах и прогнозирования векторов развития европейского интеграционного проекта.</p></abstract><abstract xml:lang="en" abstract-type="summary"><p>The article analyzes the legal nature of the European Union as a source of legal anomie — a state of regulatory uncertainty arising from the contradiction between the supranational legal order and classical state sovereignty. The study aims to conceptualize anomie as a structural feature of European integration, identifying its doctrinal origins and institutional manifestations. The methodological framework combines formal legal analysis (examining ECJ precedents and acts of Member States’ constitutional courts) with a systemic-functional approach to assess the EU as a hybrid legal entity. The article demonstrates that ECJ rulings (Van Gend en Loos, Costa v. ENEL) laid the foundations of legal anomie, while the response of national constitutional courts (Germany, Poland, Czechia, Italy) has turned it into a full-fledged legitimacy crisis. Using examples of economic shocks, the migration crisis, the COVID-19 pandemic, digital transformation and Brexit, the author shows how regulatory uncertainty becomes a mode of «governance through exceptions». The scientific novelty lies in substantiating the concept of «legal anomie» as an integrating characteristic of the contemporary EU legal order, reflecting the systemic conflict between supranational regulation and constitutional sovereignties.
