В статье автор рассматривает политико-правовые взгляды на вопросы войны и мира В.А. Незабитовского, одного из выдающихся российских юристов второй половины XIX века. По результатам анализа делается вывод об актуальности и многогранности таких воззрений. Как человек гуманистического мировоззрения, он выступал против войны, за вечный мир и мирные способы разрешения межгосударственных споров. Как прагматик он понимал, что в текущем моменте времени идеалистические цели вечного мира практически недостижимы. Поэтому существенное внимание в его работах и выступлениях уделялось мерам смягчения жестокости войн и тяжести их последствий. Как ученый он отмечал ключевые характеристики войн: политико-правовой характер войн; ограничение форм военных действий; необходимость отличать вооруженные силы и мирное население; увеличение степени разрушительности и кровопролитности войн; гуманизация отношения к представителям противоборствующей стороны и нейтральных государств; глобальный характер войн и их последствий. Как юрист – международник он выступал сторонником мягкого права, отдавая предпочтения «обычаям», «здравому смыслу и совести государств» перед конкретными императивными соглашениями.

In the article, the author examines the political and legal views of V.A. Nezabitovsky, one of the outstanding Russian lawyers of the second half of the 19th century, on the issues of war and peace. Based on the analysis, the conclusion is drawn about the multifaceted nature of such views. As a proponent of a humanistic worldview, he opposed war, advocated for eternal peace, and supported peaceful methods of resolving interstate disputes. As a pragmatist, he understood that, at the present time, the idealistic goals of eternal peace were practically unattainable. Therefore, a significant portion of his works and speeches focused on measures to mitigate the brutality of wars and the severity of their consequences. As a scholar, he noted the key characteristics of the wars of his time: the political and legal nature of wars; the limitation of the forms of military action; the need to distinguish between armed forces and the civilian population; the increasing degree of destructiveness and bloodshed in wars; the humanization of the attitude towards representatives of the opposing side and neutral states; and the global nature of wars and their consequences. As an international lawyer, he advocated for soft law, preferring “customs,” “common sense, and the conscience of states” over specific mandatory agreements.
