Автор рассматривает правовую природу юридических лиц, не обладающих правом собственности на свое имущество, проблемы и особенности правоприменительной практики, связанные с их особым статусом, а также исторические предпосылки существования данного вида юридических лиц. В данной работе детально исследуются особенности статуса и правоприменительной практики в связи с каждым из трех режимов субсидиарной ответственности. Особое внимание уделяется позициям Верховного суда РФ и Конституционного суда РФ по ряду проблем, актуальных и в настоящее время, таких как проблема невозможности взыскания задолженности с ликвидируемых бюджетных автономных учреждений по общему правилу, что существенно сужает гарантии для кредиторов и требует от них повышенной осмотрительности при вступлении в договорные отношения с государственными учреждениями. Анализируются исключения из общих правил, в частности связанные с привлечением к субсидиарной ответственности собственников имущества бюджетного учреждения по обязательствам, проистекающим из публичных договоров электроснабжения в связи с нахождением/не нахождением учреждения в процессе ликвидации. В заключении делается вывод о том, что существующая на настоящее время дифференцированная система субсидиарной ответственности, направленная на сохранение определенной финансовой автономии бюджетных и автономных учреждений, одновременно приводит к сохранению повышенных рисков у контрагентов учреждений, а также порождает ряд правовых пробелов, что требует дальнейшего совершенствования законодательного регулирования деятельности государственных учреждений.</p></abstract><abstract xml:lang="en" abstract-type="summary"><p>This article examines and analyzes the institution of subsidiary liability of public law entities (the Russian Federation, subjects of the Russian Federation, and municipalities) for the obligations of state and municipal institutions they have created. The author examines the legal nature of legal entities that do not own their property, the problems and features of law enforcement practice related to their special status, as well as the historical background of the existence of this type of legal entity. This paper examines in detail the features of the status and law enforcement practice in connection with each of the three subsidiary liability regimes. Special attention is paid to the positions of the Supreme Court of the Russian Federation and the Constitutional Court of the Russian Federation on a number of issues that are still relevant today, such as the problem of the inability to collect debts from liquidated budgetary autonomous institutions as a general rule, which significantly narrows guarantees for creditors and requires them to be more careful when entering into contractual relations with government agencies. The article analyzes exceptions to the general rules, in particular those related to the subsidiary liability of the owners of the property of a budgetary institution for obligations arising from public electricity supply contracts in connection with the establishmen​t/​non‑establis​hment of the institution in the process of liquidation.
