Одним из макроэкономических трендов последних десятилетий выступает переход от линейной экономики к циркулярной, предполагающий снижение площадей мусорных полигонов и оптимизацию расходов на добычу ограниченного природного сырья. Намерение включить отечественную систему права в данный тренд прослеживается в отечественной нормативно-правовой базе последних лет, однако в принимаемых законодательных решениях обнаруживаются противоречия. В статье рассматриваются проблемы трёх новелл законодательства об отходах производства и потребления, а именно расширения понятия утилизации за счёт энергетической утилизации, экологического сбора в системе расширенной ответственности производителей и категории вторичных ресурсов. Показано, что каждое из данных решений, устраняя отдельный недостаток предшествующего регулирования, порождает собственное противоречие, а бремя достижения целей циркулярной экономики при этом возлагается на хозяйствующих субъектов и граждан.

One of the macroeconomic trends of recent decades is the transition from a linear to a circular economy, which involves reducing the area of landfills, optimizing the costs of extracting limited natural raw materials, and improving the quality of manufactured products. The intention to integrate Russia into this trend can be traced in the domestic regulatory framework of recent years, although the legislative decisions taken do not form a consistent system. The article examines the problems of three recent innovations in production and consumption waste legislation, namely the expansion of the concept of waste disposal through energy utilization, the environmental fee within the extended producer responsibility system, and the category of secondary resources. It is shown that each of these decisions, while eliminating a particular shortcoming of prior regulation, generates its own contradiction, and the burden of achieving circular economy goals is placed on economic entities and citizens.
