Отмечается, что стремительное распространение автономных и адаптивных технологий делает затруднительным применение классической деликтной конструкции, построенной на установлении вины конкретного причинителя вреда. Автор последовательно рассматривает три модели, известные отечественному и зарубежному правопорядкам, — ответственность за продукт, строгую (безвиновную) ответственность и страхование ответственности, — раскрывая условия их применения и присущие им ограничения. Особое внимание уделяется критериям выбора конкретной модели применительно к различным категориям споров: степени автономности системы, прослеживаемости причинной связи и масштабу использования технологии. Обосновывается обращение к теории альтернативной причинности как инструменту преодоления доказательственных сложностей при множественности потенциальных делинквентов. Делается вывод о необходимости дифференцированного, а не единого подхода к регулированию ответственности за вред, причинённый искусственным интеллектом, в российском гражданском праве.</p></abstract><abstract xml:lang="en" abstract-type="summary"><p>The article examines models of property liability for harm caused by the operation of artificial intelligence systems. It argues that the rapid spread of autonomous and adaptive technologies complicates the application of the classical tort construction based on establishing the fault of a specific tortfeasor. The author successively analyses three models known to Russian and foreign legal orders — product liability, strict liability, and liability insurance — revealing the conditions for their application and their inherent limitations. Particular attention is paid to the criteria for selecting a specific model for different categories of disputes: the degree of system autonomy, the traceability of the causal link, and the scale of technology use. The article substantiates recourse to the theory of alternative causation as a tool for overcoming evidentiary difficulties in cases of multiple potential tortfeasors.
