Рассматриваются положения российского законодательства, подходы судебной практики и основные доктринальные позиции относительно характера и содержания адвокатской тайны. Автором предлагается концепция «сегментарного» характера адвокатской тайны и обосновывается возможность ее применения в гражданском процессе в качестве способа определения сферы ее действия. Для развития данного подхода исследуется зарубежный опыт, в частности американские доказательственные привилегии attorney-client privilege и work product doctrine, а также критерии, используемые судами США при разграничении защищаемой и незащищаемой информации. На основе проведенного анализа предлагается рассматривать функциональную связь сведений с оказанием юридической помощи в качестве одного из ключевых критериев определения пределов адвокатской тайны. Обосновывается, что уточнение границ соответствующей защиты способно повысить предсказуемость судебной практики и обеспечить более последовательное применение института адвокатской тайны в гражданском и арбитражном процессе.</p></abstract><abstract xml:lang="en" abstract-type="summary"><p>The article addresses the problems arising from the uncertainty surrounding the scope of attorney-client confidentiality in the context of civil and commercial proceedings, as well as the broad judicial discretion in determining the criteria that information must meet when considering issues of the admissibility and disclosure of evidence. The study examines the provisions of Russian legislation, approaches developed in judicial practice, and major doctrinal positions concerning the nature and scope of attorney-client confidentiality. The author proposes the concept of the “segmental” nature of attorney-client confidentiality and substantiates the possibility of applying this concept in civil proceedings as a means of defining the scope of its protection. To further develop this approach, the article examines foreign experience, in particular the U.S. evidentiary privileges of attorney-client privilege and the work product doctrine, as well as the criteria applied by U.S. courts when distinguishing between protected and unprotected information. Based on the analysis, the author proposes considering the functional connection between the information and the provision of legal services as one of the key criteria for determining the scope of attorney-client confidentiality.
