Авторы прослеживает эволюцию научных взглядов на природу местного права, его соотношение с общегосударственным, а также частно-правовым законодательством и значение в рамках имперской правовой системы. Особое внимание уделено анализу подходов ведущих представителей юридической науки того времени, которые по разному трактовали допустимость и пределы сохранения региональных правовых особенностей в условиях централизации правового регулирования.
В работе рассматриваются концептуальные взгляды отечественных дореволюционных правоведов на конкретные примеры партикулярных правовых режимов (в том числе Северного и Восточного Кавказа), а также механизмы их интеграции в общеимперское правовое пространство. Показано, как в трудах дореволюционных учёных отражались политические и управленческие задачи государства: с одной стороны – стремление к унификации законодательства, с другой – необходимость учёта историко правовых традиций отдельных территорий.
Авторы раскрывает дискуссионные аспекты проблемы: от признания местного права как легитимного элемента правовой системы до его восприятия в качестве препятствия на пути формирования единого правового порядка. В статье также обозначены ключевые теоретические позиции, определившие дальнейшее развитие представлений о соотношении общего и особенного в праве, и показана их значимость для понимания специфики российского имперского правопорядка. Представленное исследование опирается на широкий круг дореволюционных источников и научных публикаций, что позволяет составить целостное представление о состоянии доктрины в данной сфере.</p></abstract><abstract xml:lang="en" abstract-type="summary"><p>This article examines the place and role of particular (local) law in the doctrinal understanding of Russian legal scholars in the late 19th and early 20th centuries. The authors trace the evolution of scholarly views on the nature of local law, its relationship with national and private law, and its significance within the imperial legal system. Particular attention is paid to analyzing the approaches of leading legal scholars of the time, who interpreted differently the permissibility and limits of preserving regional legal peculiarities in the context of centralized legal regulation.
The paper examines the conceptual views of Russian pre‑revolutionary legal scholars on specific examples of particular legal regimes (including those in the North and East Caucasus), as well as the mechanisms for their integration into the imperial legal space. It demonstrates how the works of pre‑revolutionary scholars reflected the political and administrative objectives of the state: on the one hand, the desire for legislative unification, on the other, the need to take into account the historical and legal traditions of individual territories. The authors explore controversial aspects of the issue: from the recognition of local law as a legitimate element of the legal system to its perception as an obstacle to the formation of a unified legal order. The article also outlines key theoretical positions that shaped the subsequent development of ideas about the relationship between the general and the specific in law and demonstrates their significance for understanding the specifics of the Russian imperial legal order.
