Проблема рассматривается через противоречие между массовой доступностью цифрового производства и необходимостью сохранить связь правовой охраны с личным творческим участием человека. На основе анализа гражданского законодательства, научных подходов и судебных актов выявлены пределы применения традиционных конструкций авторства к результатам, создаваемым при участии алгоритмических систем. Обосновывается, что юридическая оценка должна зависеть не от самого факта использования технологии, а от характера участия человека в формировании итогового результата и возможности отделить его вклад от автоматически созданных элементов. Показано, что единый правовой режим для всех результатов генерации приводит либо к необоснованному расширению авторской охраны, либо к отрицанию прав на произведения, в которых искусственный интеллект выполняет вспомогательную функцию. Предложено разграничивать правовые последствия в зависимости от степени самостоятельности человеческого участия, сохраняя охрану тех элементов, которые обусловлены индивидуальными творческими решениями. Отдельно рассмотрено влияние генеративных технологий на профессиональное признание авторов и распределение прав в коллективной и служебной деятельности. Сделан вывод о необходимости доказательственного подхода, позволяющего установить происхождение охраняемой формы без превращения технической фиксации процесса в условие возникновения авторских прав. Результаты исследования могут применяться при разрешении споров, подготовке договоров и разработке локальных правил использования искусственного интеллекта в креативных индустриях. Такой подход обеспечивает более последовательное разграничение авторства, правообладания и технологического участия в цифровом производстве.</p></abstract><abstract xml:lang="en" abstract-type="summary"><p>This article examines the transformation of copyright qualification in the context of the growing use of generative artificial intelligence. The issue is considered through the tension between the mass accessibility of digital content production and the need to preserve the connection between legal protection and an individual’s personal creative contribution. Based on an analysis of civil legislation, academic approaches, and judicial decisions, the study identifies the limits of applying traditional concepts of authorship to outputs created with the involvement of algorithmic systems. It is argued that legal assessment should depend not on the mere use of technology, but on the nature of human participation in shaping the final result and on whether that contribution can be distinguished from automatically generated elements. The article demonstrates that applying a uniform legal regime to all AI‑generated outputs may lead either to an unjustified expansion of copyright protection or to the denial of rights in works where artificial intelligence performs an auxiliary function. It is proposed that legal consequences be differentiated according to the degree of independent human participation, while preserving protection for elements resulting from individual creative choices. Particular attention is paid to the impact of generative technologies on the professional recognition of authors and on the allocation of rights in collective and employment-related creative activity. The article concludes that an evidence-based approach is required to establish the origin of the protected form without turning technical documentation of the creative process into a condition for the emergence of copyright. The findings may be applied in dispute resolution, contract drafting, and the development of internal rules governing the use of artificial intelligence in the creative industries.
