Использованы формально-юридический, сравнительно-правовой, функциональный и сценарный методы. Обосновано, что при действующей Конституции Российской Федерации ИИ не может быть самостоятельным носителем судебной власти: вероятен переход не к «электронному судье», а к проверяемому цифровому помощнику. Разграничены задачи, в которых технически возможно исключить именно выдумывание сведений, и задачи, где нулевая ошибка недостижима. Показано, что нормативные акты и опубликованные решения образуют корпус юридических текстов, но не репрезентативный корпус доказывания: в нем отсутствует систематический доступ к полным материалам дел, конкурирующим версиям фактов и значительной части контекста исследования доказательств. Научная новизна состоит в доказательственно-ориентированной модели судебного ИИ, включающей защищенный контур полных электронных дел, разметку предмета и бремени доказывания, прослеживаемость каждого вывода, право системы на отказ от ответа и обязательную состязательную проверку.</p></abstract><abstract xml:lang="en" abstract-type="summary"><p>The article examines the legally permissible and technically realistic uses of AI in Russian administrative proceedings. It argues that, under the current constitutional framework, AI cannot exercise judicial power independently and should remain a non‑binding, auditable assistant. The study distinguishes deterministic or extractive functions, where fabrication can be blocked at the system level, from semantic tasks for which zero error cannot be guaranteed. Publicly available statutes and judgments provide legal language but not a representative evidentiary record because full case files, competing factual narratives and procedural context are generally absent from open training corpora.
