Статья посвящена оценке обоснованности выделения демографического права и демографического законодательства в качестве самостоятельных отраслей соответственно права и законодательства. Возможность их отраслевого обособления проверяется на основе предмета и метода правового регулирования, а также дополнительных критериев, выработанных юридической наукой; отдельно рассматривается их возможная комплексная природа. Обосновывается вывод об отсутствии у соответствующего нормативного массива достаточно определённых границ и собственного юридического единства. Понятие демографического законодательства предлагается использовать для обозначения тематического межотраслевого массива, а в качестве более продуктивной единицы анализа – категорию демографически значимого правового института.

This article assesses whether demographic law and demographic legislation can be recognized as distinct branches of law and legislation, respectively. Their potential recognition as such is examined against the subject matter and method of legal regulation, as well as additional criteria developed in legal scholarship; the possibility of classifying them as complex branches is considered separately. It is argued that the relevant body of legal norms has neither sufficiently determinate boundaries nor the internal legal coherence required for recognition as a distinct branch. The term demographic legislation may nevertheless be used to denote a thematic body of legal norms drawn from different branches of law, while the concept of a demographically significant legal institution is proposed as a more productive unit of analysis.
