В настоящем исследовании проводится сравнительный анализ степени вовлечённости лиц в деятельность организации при их привлечении к субсидиарной ответственности в рамках дела о банкротстве на примере судебных актов за период с 2020 по 2026 годы. Необходимость исследования обусловлена частыми злоупотреблениями институтом банкротства юридического лица, при котором недобросовестными участниками используются способы сокрытия фактических бенефициаров его деятельности от третьих лиц. С целью выявления таких злоупотреблений, а также предложения путей их предотвращения автором анализируются устоявшиеся подходы к выявлению таких лиц посредством установления степени вовлеченности в финансовохозяйственную деятельность организации, приведшую к её банкротству в судебных актах Верховного Суда Российской Федерации. По результатам проведенного исследования предлагается сформировать критерии степени вовлеченности, объединенные в единую классификацию.

This study provides a comparative analysis of the degree of involvement of individuals in the activities of an organization when they are held liable for subsidiary liability in a bankruptcy case, based on court decisions from 2020 to 2026. The need for research is due to the frequent abuse of the institution of legal entity bankruptcy, in which unscrupulous participants use methods to conceal the actual beneficiaries of their activities from third parties. In order to identify such abuses and suggest ways to prevent them, the author analyzes established approaches to identifying such individuals by establishing the degree of involvement in the financial and economic activities of the organization that led to its bankruptcy in the judicial acts of the Supreme Court of the Russian Federation. Based on the results of the study, it is proposed to form criteria for the degree of involvement, which are combined into a single classification.
