В статье проводится комплексный анализ понятия убийства в россий ском уголовном праве. Автор исследует соотношение легального определения, закреплен ного в ч. 1 ст. 105 УК РФ, с доктринальными позициями ведущих ученых-правоведов. В рабо теподробно рассматриваются элементы состава преступления. Особое внимание уделя ется определению временных границ жизни человека как объекта посягательства на осно веинтеграции уголовно-правовых норм и законодательства об охране здоровья граждан и признакам убийства. Обосновывается вывод о том, что научное понимание убийства значительно шире его законодательной формулировки, что имеет важное значение для правильной квалификации преступных деяний

This article provides a comprehensive analysis of the concept of murder in Russian criminal law. The author examines the relationship between the legal definition enshrined in Part 1 of Article 105 of the Russian Criminal Code and the doctrinal positions of leading legal scholars. The work examines in detail the elements of the crime. Particular attention is paid to defining the time limits of a person’s life as the target of an attack based on the integration of criminal lawnorms and legislation on public health protection and the elements of murder. The author concludes that the scientific understanding of murder is significantly broader than itslegislative formulation, which is essential for the proper classification of criminal acts
