Настоящая статья посвящена исследованию содержания и видов цифровых финансовых активов в системе гражданского права Российской Федерации. В ходе сравнительно-правового анализа выявлено, что, несмотря на нормативное закрепление нескольких видов ЦФА, их правовое регулирование носит фрагментарный характер и не обеспечивает единообразия в механизмах их обращения и реализации прав их обладателей. Особое внимание уделено проблеме расширительного толкования легального определения ЦФА, допускающего их выпуск внесистем распределённого реестра, что приводит к размыванию сущности данной категории и смешению с иными цифровыми объектами. По результатам исследования сделан вывод о необходимости уточнения законодательной дефиниции ЦФА, а также формирования комплексного подхода к их классификации и правовому регулированию с учётом их экономической природы и технологических особенностей

This article is devoted to the study of the content and types of digital financial assets within the system of civil law of the Russian Federation. The comparative legal analysis reveals that, despite the statutory recognition of several types of digital financial assets, their legal regulation remains fragmented and does notensure uniformity in the mechanisms of their circulation and the exercise of the rights of their holders. Particular attention is paid to the problem of the expansive interpretation of the legal definition of digital financial assets, which allows their issuance outside distributed ledger systems, thereby leading to a blurring of the essence of this category and itsconflation with other digital objects. Based on the results of the study, the author concludes that it is necessary to clarify the legislative definition of digital financial assets and to develop a comprehensive approach to their classification and legal regulation, taking into account their economic nature and technological features
