Настоящая статья открывает цикл авторских статей, посвященных малоисследованной в отечественном российском конституционализме теме протокон ституционных актов (т.н. «ранних российских конституций»), исторически предшество вавших разработке и принятию советских и современных конституционных актов России. Обосновывается, что начало отечественной конституционной традиции не следует связывать исключительно с Конституцией РСФСР 1918 г., поскольку еще в Российской Импе риибыли сформированы правовые идеи ограничения верховной власти, народного предста вительства, законности, прав подданных и институционального разграничения властных функций. Предметом анализа настоящей статьи (первой части цикла статей) выступа ют «Кондиции» Анны Иоанновны 1730 г. и «Наказ» Екатерины II 1767 г. Автор исходит из различения формальной конституции, конституционного проекта и протоконституцион ного акта. Делается вывод о том, что дореволюционный российский конституционализм развивался как конфликт между самодержавной природой имперской государственности и потребностью в правовом самоограничении публичной власти. Его незавершенность не отменяет факта существования глубокой дореволюционной конституционно-правовой традиции

This article opens a series of author’s articles on the topic of proto-constitutional acts (the so-called “early Russian constitutions”), which historically preceded the development and adoption of Soviet and modern constitutional acts of Russia, little-researched in Russian Russian constitutionalism. It is justified that the beginning of the domestic constitutional tradition should not be associated exclusively with the Constitution of the RSFSR of 1918, since even in the Russian Empire legal ideas were formed to limit supreme power, popular representation, legality, the rights of subjects and the institutional delimitation of power functions. The subject of analysis of this article (the first part of the series of articles) are the “Conditions” of Anna Ioannovna in 1730 and the “Order” of Catherine II in 1767. The author proceeds from the distinction between the formal constitution, the constitutional draft and the protoconstitutional act. It is concluded that pre-revolutionary Russian constitutionalism developed as a conflict between the autocratic nature of imperial statehood and the need for legal self-restraint of public power. Its incompleteness does not negate the fact of the existence of a deep pre-revolutionary constitutional and legal tradition.
