В статье представлен ретроспективный анализ эволюции принципов российского судопроизводства, начиная с эпохи Великих реформ Александра II и заканчивая современным состоянием уголовно-процессуального законодательства. Автор концентрирует внимание на концептуальных «разрывах» и точках преемственности в отечественном судопроизводстве. Особое внимание уделено деформации принципов состязательности и непосредственности в советский период, а также их непростой «реанимации» в условиях современности. В статье критически осмысливается феномен «обвинительного уклона» как наследия инквизиционного процесса и анализируются риски, связанные с цифровизацией правосудия. Сделан вывод о том, что полноценное возрождение духа судебной реформы 1864 года невозможно безментальной трансформации профессионального правосознания

The article presents a retrospective analysis of the evolution of the principles of Russian legal proceedings, starting from the era of Alexander II’s Great Reforms and ending with the current state of criminal procedural legislation. The author focuses on the conceptual “breaks” and points of continuity in domestic legal proceedings. Special attention is given to the deformation of the principles of adversarialism and immediacy during the Soviet period, aswell astheir challenging “resuscitation” in modern times. The article critically examines the phenomenon of the “accusatorial bias” as a legacy of the inquisitorial process and analyzes the risks associated with the digitalization of justice. It is concluded that a full-fledged revival of the spirit of the 1864 judicial reform is impossible without a mental transformation of professional legal consciousness
