В ходе анализа было выявлено, что использование ИИ для определения размера оплаты труда работников создает угрозу принципам справедливости, равенства и недискриминации в оплате труда. Исходя из технических особенностей работы сложных алгоритмов, были выделены 3 основные проблемы, возникающие при полном делегировании принятия решений по вопросам оплаты труда ИИ: принцип «черного ящика» или непрозрачность логики принятия решений системой; дискриминация, как явная (например, по половому признаку), так и неявная, выражающаяся в некорректном определении системой нормы работы, от которой следует отталкиваться при оценке эффективности каждого работника; недостаточность учета человеческого фактора при принятии решений об оплате труда. Нарушения принципов трудового права и прав отдельных работников могут проявляться не только в виде решений о сумме заработной платы или ее отдельных частей, но и в распределении объема работы между работниками, основываясь на их относительной оценке, когда размер оплаты зависит от объема выполненной работы. Для обеспечения соответствия решений об оплате труда, принимаемых с использованием алгоритмов, принципам оплаты труда, автором работы предлагается введение ряда мер, направленных на увеличение прозрачности и обоснованности таких решений</p></abstract><abstract xml:lang="en" abstract-type="summary"><p>In this article, the author examines existing and potential risks of violating wage principles when organizing the process of calculating employee wages exclusively through the use ofalgorithms, including artificial intelligence.The analysis revealed  that the use of AI to determine employee wages poses a threat to the principles of fairness, equality, and non-discrimination in remuneration. Based on the technical characteristics of complex algorithms, three main problems were identified that arise when decision-making regarding remuneration is fully delegated to AI: the “black box” principle, or the opacity of the system’s decision-making logic; discrimination, both explicit (e.g., based on gender) and implicit, manifested in the system’s incorrect determination of the performance standard used to assess each employee’s effectiveness; insufficient consideration of the human factor in making decisions regarding remuneration. Violations of labor law principles and the rights of individual employees may manifest not only in decisions regarding the total amount of wages or their individual components, but also in the distribution of workloads among employees based on their relative performance evaluations, where compensation depends on the volume of work completed.
