Объектом данного исследования выступаю общественные отношения, складывающиеся в сфере реализации права на образование детьми из семей участников специальной военной операции. Предмет исследования - нормы российского законодатель ства, подзаконные акты, включая Указы Президента Российской Федерации, а также реги ональные нормативные правовые акты, устанавливающие гарантии и льготы для указан нойкатегории семей в области дошкольного и общего образования. Цель работы - комплексный анализ действующего механизма правовых гарантий, выявлении проблем его реализации и разработке научно обоснованных предложений по повышению эффективности защиты прав детей из семей участников СВО в образовательной сфере. Для достижения поставленной цели в работе решаются следующие задачи: 1. анализируется понятийный аппарат и дифференциация правового регулирования в зависимости от уровня образова ния; 2. исследуется связь реализуемых гарантий с указами главы государства; оценивает сяправоприменительная практика; 3. формулируются рекомендации по совершенствова ниюмеханизма гарантий. Представлена авторская классификация правовых гарантий по критерию уровня образования и механизма реализации. Выявлена системная проблема межведомственного взаимодействия при предоставлении льгот, а также в разработке модели «единого окна» и предложений по внесению изменений в Федеральный закон «Об образовании в Российской Федерации» для унификации прав детей участников СВО на всей территории страны

This study examines social relations surrounding the exercise of the right to education by children from families of special military operations participants. Itfocuses on Russian legislation, bylaws, including Decrees of the President of the Russian Federation, and regional regulations establishing guarantees and benefits for this category of families in the area of preschool and general education. The objective of this study is to comprehensively analyze the current mech anism of legal guarantees, identify implementation issues, and develop scientifically sound propos als for improving the protection of the rights of children from families of special military operations participants in the educational sphere. To achieve this goal, the study addresses the following objec tives: 1. Analyzes the conceptual framework and differentiates legal regulation depending on the level of education; 2. Examines the relationship between the implemented guarantees and decrees of the head of state; evaluates lawenforcement practice; 3. Formulates recommendations for improving the guarantee mechanism. The author presents a classification of legal guarantees based on the criterion of educational level and the implementation mechanism. A systemic problem with inter departmental cooperation in the provision of benefits wasidentified, aswell as in the development of a “single-window” model and proposals for amendments to the Federal Law “On Education in the Russian Federation” to standardize the rights of children of SVOparticipants throughout the country
