В статье представлен анализ правового режима брачного договора в российской правовой системе: исследуются исторические этапы становления данного института, особое внимание уделяется социокультурному аспекту — специфике восприятия брачного договора в российском обществе. В исследовании подробно рассматриваются основания признания брачного договора недействительным, раскрывается понятие «крайне неблагоприятное положение» супруга, приведена актуальная судебная практика по данным спорам, а также исследуется специфика оспаривания брачных договоров в рамках процедур банкротства граждан. В работе подробно рассматриваются требования к форме заключения договора и раскрывается фундаментальная роль нотариуса в обеспечении законности и защиты прав супругов и третьих лиц при заключении брачного договора

The article presents an analysis of the legal regime of the marriage contract in the Russian legal system: the historical stages of the formation of this institution are investigated, special attention is paid to the socio—cultural aspect - the specifics of the perception of the marriage contract in Russian society. The study examines in detail the grounds for invalidating a marriage contract, reveals the concept of an “extremely unfavorable position” of a spouse, provides current judicial practice on these disputes, and also examines the specifics of challenging marriage contracts in the framework of bankruptcy procedures for citizens. The paper examines in detail the requirements for the form of concluding a contract and reveals the fundamental role of a notary in ensuring the legality and protection of the rights of spouses and third parties when concluding a marriage contract
