Рассматри вается соотношение между привнесённым португальским колониальным правом, традици онными нормами обычного права местных африканских обществ, а также исламской правовой традицией в регионах с мусульманским населением. Показано, что несмотря на официальную политику ассимиляции, на практике в колониях сложилась дуалистическая право ваясистема: наряду с законами метрополии действовали местные обычаи, а в отдельных регионах – нормы шариата. Историко-правовой и сравнительно-правовой анализ позволя етвыявить, как португальская колониальная администрация пыталась подчинить и трансформировать этисистемы права, и какие последствия это имело для постколони ального развития правовой системы указанных стран</p></abstract><abstract xml:lang="en" abstract-type="summary"><p>The article examines the phenomenon of legal pluralism in the former Portuguese colonies in Africa, with particular attention to Angola, Mozambique, and Guinea-Bissau. Itanalyses the relationship between Portuguese colonial lawintroduced by the metropolitan authorities, tradi tional customary norms of African societies, and the Islamic legal tradition in regions with Muslim populations. The study demonstrates that, despite the officially proclaimed policy of assimilation, a dual legal system emerged in practice: alongside the law of the metropole, customary lawcontinued to operate, while in certain regions Islamic legal norms were applied.
