Анализируется влияние британского, французского и бельгийского колониального права на формирование на циональных правовых порядков, прослеживается механизм встраивания обычного (тради ционного) права в постколониальные государственные структуры. Рассматривается феномен правового плюрализма как устойчивой черты африканских правовых систем, при которой нормы государственного законодательства сосуществуют с обычно-правовыми практиками и, в ряде регионов, с нормами исламского права. Показано, что несмотря на декларируемый курс на правовую унификацию, большинство стран Тропической Африки по-прежнему функционируют в условиях многоуровневого нормативного порядка, порожда ющего как правоприменительные трудности, так и уникальные механизмы урегулирования споров. Особое внимание уделено реформам конца XX — начала XXIвека и возникающим в их ходе противоречиям между требованиями международных стандартов в области прав человека и укоренёнными традиционными нормами</p></abstract><abstract xml:lang="en" abstract-type="summary"><p>The article examines the legal systems of Sub-Saharan African states in their historical development and contemporary condition. Itanalyses the impact of British, French, and Belgian colonial law on the formation of national legal orders, and traces the mechanism by which customary (traditional) lawwasincorporated into post-colonial state structures. The phenomenon of legal pluralism is considered as a persistent feature of African legal systems, wherein state legisla tion coexists with customary legal practices and, in certain regions, with Islamic law. The study demonstrates that, despite declared policies of legal unification, most Sub-Saharan states continue to operate within a multilayered normative order that generates both law-enforcement difficulties and unique dispute resolution mechanisms.
