Настоящая статья посвящена исследованию системы правовой охраны традиционных знаний (далее — ТЗ) в Российской Федерации, включая анализ действующего законодательства, международных договорных обязательств страны и пробелов нормативного регулирования. Автором обосновывается тезис о том, что сложившаяся правовая конструкция носит фрагментарный характер и не обеспечивает ни позитивной, ни защитной охраны ТЗ как самостоятельного правового объекта. Особое внимание уделяется анализу субъектного состава правоотношений в сфере ТЗ, коллективным моделям правообладания, специфике народных художественных промыслов (далее — НХП) как разновидности традиционных выражений культуры (далее — ТВК). На основе критического анализа международного опыта и доктринальных концепций — в том числе Договора ВОИС об интеллектуальной собственности, генетических ресурсах и традиционных знаниях, принятого 24 мая 2024 года, и проекта документа WIPO/GRTKF/IC/49/4 — предлагается пятиуровневая модель системного совершенствования российского законодательства. В статье сформулированы конкретные законодательные предложения: поправки в часть четвёртую Гражданского кодекса Российской Федерации, Федеральный закон № 82-ФЗ и Федеральный закон № 402-ФЗ, а также разработана концепция специального федерального закона об охране ТЗ и ТВК. Предлагаемые меры направлены на устранение выявленных правовых пробелов и формирование гибридной модели охраны, сочетающей коллективные права общин с государственной защитной охраной ex officio.

This article examines the legal protection system for traditional knowledge (hereinafter — TK) in the Russian Federation, including an analysis of existing legislation, international treaty obligations, and gaps in normative regulation. The author substantiates the thesis that the existing legal framework is fragmentary in nature and provides neither positive nor defensive protection for TK as an independent legal object. Special attention is given to the analysis of the subject composition of legal relations in the TK sphere, collective models of rights-holding, and the specifics of folk arts and crafts (FAC) as a variety of traditional cultural expressions (TCE). Based on a critical analysis of international experience and doctrinal concepts — including the WIPO Treaty on Intellectual Property, Genetic Resources, and Associated Traditional Knowledge (adopted May 24, 2024) and the draft document WIPO/GRTKF/IC/49/4 — a five-level model of systemic improvement of Russian legislation is proposed. The article formulates specific legislative proposals: amendments to Part Four of the Civil Code of the Russian Federation, Federal Laws No. 82-FZ and No. 402-FZ, and develops the concept of a special federal law on the protection of TK and TCE.
