В статье в проблемном ключе рассматривается правопорядок как социально-юридический феномен, анализируемый сквозь призму культуры. На взгляд автора статьи, правопорядок не может быть понят вне культурного контекста, вне традиций, ценностей, норм и образцов поведения, укоренённых в сознании и повседневной жизни народа. Предлагается различать узко-юридическое (формальное) и широкое (культурологическое) понимание правопорядка. На основе данных истории, антропологии, философии права и культурологии выделяются восточный и западный типы правопорядка, а также смешанные и переходные формы. Автор обращает внимание, что правопорядок не только устанавливается государством, но и «вырастает» из культуры, поэтому его устойчивость и легитимность напрямую зависят от соответствия культурным кодам общества. Особое внимание уделено соотношению традиции и новации в поддержании правопорядка, а также роли правосознания, языка, религии и морали. Констатируется, что теоретическая разработка проблематики правопорядка в дискурсе культуры ещё далека от завершения и требует дальнейших междисциплинарных исследований.

The article examines, in a problem-oriented manner, the legal order as a sociolegal phenomenon analyzed through the prism of culture. In the opinion of the author of the article, legal order cannot be understood outside the cultural context, outside the traditions, values, norms and patterns of behavior rooted in the consciousness and everyday life of the people. It is proposed to distinguish between a narrow (formal) legal understanding of legal order and a broad (culturological) one. Based on data from history, anthropology, philosophy of law and cultural studies, Eastern and Western types of legal order, as well as mixed and transitional forms, are identified. The author notes that legal order is not only established by the state but also «grows» out of culture, therefore its stability and legitimacy directly depend on compliance with the cultural codes of society. Special attention is paid to the relationship between tradition and innovation in maintaining legal order, as well as to the role of legal consciousness, language, religion and morality. It is stated that the theoretical development of the issues of legal order in the discourse of culture is still far from complete and requires further interdisciplinary research.
