В статье рассматриваются актуальные проблемы правовой идентифи кации и определения понятия «цифровая экосистема». Автор анализирует генезис терми на, его заимствование из биологии в экономику и право, а также существующие в научной литературе и нормативных актах разночтения в его трактовке. Особое внимание уделя ется соотношению понятий «цифровая платформа» и «цифровая экосистема». Исследу ются подходы к правовому регулированию цифровых экосистем в России и за рубежом. Обосновывается необходимость разработки и принятия системообразующего закона, уста навливающего основы правового регулирования цифровых экосистем в российской эконо мике, с учетом баланса между инновационным развитием, конкуренцией и защитой прав участников

This article examines current issues in the legal identification and definition of the concept of “digital ecosystem.” The author analyzes the origins of the term, itsadoption from biology into economics and law, and the discrepancies in itsinterpretation in scientific literature and regula tions. Particular attention is paid to the relationship between the concepts of “digital platform” and “digital ecosystem.” Approaches to the legal regulation of digital ecosystems in Russia and abroad are explored. The need for the development and adoption of a system-forming lawestablishing the foundations for the legal regulation of digital ecosystems in the Russian economy is substantiated, taking into account the balance between innovative development, competition, and the protection of participants’ rights
