Авторами установлено, что интеграция финских земель шла поэтапно на протяжении почти века: в 1721 г. по Ништадтскому миру к России отошла Карелия с дистриктом Выборгского лена; в 1743 г. по Абоскому миру была присоединена Кюменегорская провинция; окончательное присоединение произошло в 1808–1809 гг., закреплено Фридрихсгамским мирным договором (5 сентября 1809 г.). На ранних этапах российская власть частично сохраняла шведское законодательство и местные правовые порядки. Ключевым этапом стало правление Александра I: император принял титул Великого князя Финляндского и подчинил управление княжеством лично себе. В 1809 г. был созван сейм в Борго, а манифест от 15 марта 1809 г. подтвердил сохранение религии, «коренных законов», прав и преимуществ населения. В результате сформировалось автономное положение Великого княжества Финляндского со следующими характеристиками: непосредственное подчинение императору; сохранение прежней административно управленческой и судебной системы на основе шведского законодательства (Всеобщее уложение Швеции 1807 г.); создание местных органов власти (Правительствующий совет, Комиссия финляндских дел) из финских граждан; особый порядок взаимодействия с имперскими институтами — через Комиссию финляндских дел. Таким образом, автономия княжества была дарована императорской властью при сохранении верховенства российского монарха над территорией как частью единого государства. В исследовании резюмируется, что особое правовое положение Великого княжества Финляндского было закреплено в Своде законов Российской империи 1832 г. – в ст. 4 Основных государственных законов. Это означало, что нахождение Великого княжества в составе империи обусловливается соединением в лице императора верховной власти в Финляндии с всероссийской верховной властью. Данная статья оставалась в силе вплоть до издания новых Основных государственных законов 1906 г., изменивших формулировку, но не юридическое основание нахождения княжества в составе Российской империи.</p></abstract><abstract xml:lang="en" abstract-type="summary"><p>This publication analyzes the legal status of the Grand Duchy of Finland within the Russian Empire and the stages of its annexation by Russia. The authors found that the integration of the Finnish lands occurred in stages over nearly a century: in 1721, Karelia and the Vyborg County district were ceded to Russia by the Treaty of Nystad; in 1743, the Kymenegorsk Province was annexed by the Treaty of Åbo; the final annexation occurred in 1808–1809, sealed by the Treaty of Fredrikshamn (September 5, 1809). In the early stages, Russian authorities partially retained Swedish legislation and local legal systems. A key milestone occurred during the reign of Alexander I: the emperor assumed the title of Grand Duke of Finland and subordinated the administration of the principality to himself. In 1809, the Diet convened in Borgo, and the manifesto of March 15, 1809, confirmed the preservation of religion, “fundamental laws,” and the rights and privileges of the population. As a result, the autonomous status of the Grand Duchy of Finland was established with the following characteristics: direct subordination to the Emperor; preservation of the previous administrative, managerial, and judicial system based on Swedish legislation (the General Code of Sweden of 1807); the creation of local authorities (the Governing Council, the Finnish Affairs Commission) composed of Finnish citizens; a special procedure for interaction with imperial institutions—through the Finnish Affairs Commission. Thus, the autonomy of the principality was granted by imperial power while maintaining the supremacy of the Russian monarch over the territory as part of a single state. The study summarizes that the special legal status of the Grand Duchy of Finland was enshrined in the Code of Laws of the Russian Empire of 1832—in Article 4 of the Fundamental State Laws. This meant that the Grand Duchy’s inclusion within the empire was conditioned by the unification of the supreme authority in Finland, in the person of the Emperor, with the supreme authority of all Russia.
