В статье рассмотрены вопросы оценки последствий от лесных пожаров, определена их криминалистическая характеристика. Установлена уголовно-правовая природа лесных пожаров с учетом последних рекомендаций Верховного суда России. Определено, что расследование лесного пожара на современном этапе развития общественных отношений представляет собой целый комплекс правоприменительных мер, которые выполняют должностные лица, уполномоченные на производство данной деятельности, гдепроцесс расследования неразрывно связан с выдвижением и проверкой следственных версий, которые служат средством установления фактических данных. Основа частной методики предопределяется ее рациональной структурой и дифференцированным подходом, предложены необходимые ее элементы. Сделан вывод о необходимости использования совокупности официальных методик криминалистики и научных подходов к изучению преступной деятельности в сфере противодействию лесным пожарам. Рассмотрена характеристика тактики осмотра места происшествия по делам об уничтожении или повреждении лесных насаждений, указаны типичные способы и современные технологии профилактики и выявления лесных пожаров с помощью современных технических средств, что обусловлено сложностью обстановки на месте происшествия, распространением огня на значительные площади и связанными с этими трудностями в установлении очага пожара, уничтожением многих следов и вещественных доказательств. Указаны причины следственных ошибок, рассмотрены типичные квалификационные проблемы на примере пожаров в Иркутской области. Все это служит фундаментом для построения общих и частных криминалистических версий, а также может лечь в основу схемы для формирования планов в процессе предварительного следствия по уголовном делам о лесных пожарах

The article discusses the issues of assessing the consequences of forest fires, and defines their forensic characteristics. The criminal-legal nature of forest fires hasbeen established, taking into account the latest recommendations of the Supreme Court of Russia. It is concluded that it is necessary to use a combination of official methods of criminology and scientific approaches to the study of criminal activity in the field of combating forest fires. The characteristics of the tactics of examining the scene of an incident in cases of destruction or damage to forest plantations are considered, typical methods and modern technologies for the prevention and detection of forest fires using modern technical means are indicated, due to the complexity of the situation at the scene, the spread of fire over large areas and the associated difficulties in establishing a fire source, the destruction of many traces and physical evidence. evidence. The reasons for the investigative errors are indicated, typical qualification problems are considered using the example of fires in the Irkutsk region.
