В статье рассматриваются нормативно-правовые особенности изъя тияземель сельскохозяйственного назначения для государственных и муниципальных нужд, в частности, в целях осуществления недропользования. Исследуются концептуаль ныеоснования публичного интереса, критерии допустимости изъятия, особенности процедурного регулирования, а также анализируется современная судебная практика, демон стрирующая тенденцию к ужесточению требований к обоснованию публичных нужд. На примере двух судебных дел (А13-4309/2024 и А60-58852/2023) сформулированы выводы о допустимости и пропорциональности вмешательства в право собственности

This article examines the legal and regulatory aspects of the seizure of agricultur alland for state and municipal needs, particularly for subsoil use. Itexamines the conceptual foun dations of public interest, the criteria for the admissibility of seizure, and the specifics of procedural regulation. Italso analyzes current judicial practice, which demonstrates a trend toward stricter requirements for justifying public needs. Using twocourt cases (A13-4309/2024 and A60-58852/2023) asexamples, conclusions are drawn regarding the admissibility and proportionality of interference with property rights
