Судебная реформа 1861 г. кардинально изменила судебную систему Российской империи, создав специализированные волостные суды для разрешения споров между крестьянами. Волостная юстиция стала важным элементом правосудия, охватывающим подавляющее большинство населения страны. В статье исследуются организационные основы, компетенция и функции волостных судов, созданных в рамках Общего положения о крестьянах, вышедших из крепостной зависимости. Анализируются требования к судьям, процедура их избрания, порядок судопроизводства и применение обычного права. Особое внимание уделяется реформам 1889 и 1912 гг., существенно изменившим статус волостной юстиции. Показано взаимодействие волостных судов с мировой юстицией и их роль в формировании правовой культуры крестьянства. Исследование базируется на анализе законодательных актов, архивных материалов и научной литературы. Делается вывод о противоречивости волостной юстиции, сочетавшей элементы обычного права и государственного регулирования, общинного самоуправления и административного контроля

The Judicial Reform of 1861 radically changed the judicial system of the Russian Empire by establishing specialized volost courts to resolve disputes among peasants. Volost justice became an important element of the legal system, covering the overwhelming majority of the country’s population. This article examines the organizational foundations, jurisdiction, and functions of volost courts created under the General Statute on Peasants Emerging from Serfdom. Itanalyzes the requirements for judges, the procedure for their election, the court procedure, and the application of customary law. Special attention is paid to the reforms of 1889 and 1912, which significantly altered the status of volost justice. The interaction between volost courts and justices of the peace, and their role in shaping the legal culture of the peasantry, are shown. The research is based on an analysis of legislative acts, archival materials, and scholarly literature. The conclusion highlights the contradictory nature of volost justice, which combined elements of customary law and state regulation, communal self-government and administrative control
