На основе анализа зарубежного опыта (прежде всего практики применения алго ритма COMPAS в судах США, положений Регламента ЕС 2024/1689 об искусственном интеллекте и Руководств ЮНЕСКО 2025 года) и российских инициатив в сфере цифровиза цииправосудия автор выявляет ключевые риски, связанные с непрозрачностью алгорит мов, автоматизационной предвзятостью и утратой индивидуального подхода при приня тиисудебных решений. Обосновывается, что прозрачность и объективность искусствен ного интеллекта в правосудии не являются техническими характеристиками, а представ ляют собой правовые требования, реализация которых предполагает формирование системы обязательного аудита алгоритмов, обеспечение объяснимости результатов рабо ты систем и сохранение за судьёй решающей роли в процессе. Предлагаются конкретные правовые меры, направленные на минимизацию выявленных рисков</p></abstract><abstract xml:lang="en" abstract-type="summary"><p>The article examines legal challenges in ensuring transparency and objectivity when artificial intelligence technologies are used in judicial proceedings. Drawing on an analysis of international experience — primarily the use of the COMPAS algorithm in U.S. courts, the provisions of EURegulation 2024/1689 on Artificial Intelligence, and the 2025 UNESCO Guidelines — aswell asRussian initiatives in the field of judicial digitalization, the author identifies keyrisks associated with algorithmic opacity, automation bias, and the loss of individualized approach in judicial deci sion-making. It is argued that the transparency and objectivity of artificial intelligence in the judiciary are notmerely technical characteristics butlegal requirements whose implementation requires a system of mandatory algorithmic auditing, explainability of AIoutputs, and the preservation of the judge’s decisive role in the process.
