Статья посвящена вопросам ограничения права граждан Российской Федерации на приобретение и, как следствие, владение оружием в случае наличия снятой или погашенной судимости за совершение преступлений, относящихся к определенным категориям. Показано, что правовой статус лиц, владевших оружием до 29 июня 2022 года – момента вступления в силу изменений в оружейное законодательство, является неясным ввиду одновременного наличия условий для продолжения владения и утраты такого права. Кроме того, соответствующие ограничения безразумных на тообъяснений не распространяются на граждан при приобретении имиоружия во временное пользование в целях охоты. В целях повышения эффективности правоприменения авторы предлагают внести соответствующие изменения в законодательство и разъяснить их применение высшими судебными инстанциями

The article is devoted to the issues of limiting the right of citizens of the Russian Federation to acquire and, as a result, ownweapons in the case of a criminal record for crimes belonging to certain categories that hasbeen removed or expunged. It is shown that the legal status of persons whoowned weapons before June 29, 2022, the date of entry into force of amendments to the gunlegislation, is unclear due to the simultaneous existence of conditions for continued possession and loss of such a right. In addition, the relevant restrictions without reasonable explanation donotapply to citizens when they purchase weapons for temporary use for hunting purposes. In order to increase the effectiveness of lawenforcement, the authors propose to make appropriate changes to the legislation and clarify their application by the highest judicial authorities
