Автор анализирует существующие в доктрине классификации деликтных обязательств и обосновывает, что традиционное разграничение по объекту посягательства (имущественный или моральный вред) не имеет решающего значения для наследования. Ключевым критерием оборотоспособности предлагается считать денежный характер обязанности: любое обязательство, которое может быть исполнено путём уплаты денег, утрачивает неразрывную связь с личностью должника и способно переходить к правопреемникам. На основе анализа эволюции правовых подходов в статье показан постепенный переход от модели «личного долженствования» к модели «имущественного обременения, следующего за наследственной массой». Особое внимание уделяется так называемым «пограничным» ситуациям, когда факт причинения вреда очевиден, однако к моменту смерти причинителя отсутствует судебная конкретизация размера компенсации. Автор доказывает, что сохранение различного режима правопреемства в зависимости от наличия или отсутствия судебного акта лишено логического основания и создаёт избирательную защиту прав потерпевших.</p></abstract><abstract xml:lang="en" abstract-type="summary"><p>The article examines the problem of hereditary succession in obligations arising from tort. The author analyses existing doctrinal classifications of tort obligations and argues that the traditional distinction based on the object of the infringement (pecuniary or moral harm) is not decisive for inheritance purposes. The key criterion of transferability is proposed to be the monetary nature of the obligation: any obligation that can be performed by payment of money loses its inextricable link with the debtor’s person and is capable of passing to successors. Based on an analysis of the evolution of legal approaches, the article demonstrates a gradual transition from a model of “personal obligation” to a model of “property encumbrance following the hereditary estate”. Particular attention is paid to so-called “borderline” situations where the fact of harm is obvious, yet by the time of the tortfeasor’s death there is no judicial specification of the amount of compensation.
