Обосновывается, что пользовательское лицензионное соглашение (EULA) не образует особого договорного типа, а выступает договорной формой, соединяющей лицензионные условия, правила доступа к цифровой среде и положения о пользовательском контенте. Показано, что применительно к видеоиграм и иным интерактивным цифровым системам необходимо разграничивать обычное использование продукта, создание пользовательского контента и включение такого контента в официальную экосистему правообладателя. На основе российской доктрины, судебной практики и сравнительно-правового материала сделан вывод о необходимости более точного распределения прав между правообладателем и пользователем, прежде всего в части модификаций, трансляций и коммерциализации результатов пользовательской деятельности</p></abstract><abstract xml:lang="en" abstract-type="summary"><p>The article examines licensing agreements in relation to a multimedia product as an independent complex object of copyright. Itargues that an end-user licence agreement (EULA) should not be treated as a separate contractual type; rather, itfunctions as a contractual form combining licensing terms, rules of access to the digital environment and provisions on user-generated content. The article shows that, in video games and other interactive digital systems, it is necessary to distinguish between ordinary use of the product, creation of user-generated content and incorporation of such content into the official ecosystem of the rightsholder.
