В статье представлены результаты анализа по установлению характера влияния таких проявлений технофеодализма, как рекомендательные алгоритмы и цифровые платформы, на коммерциализацию исключительных прав авторов произведений. Автором анализируются причины проблем, препятствующих такой коммерциализации в условиях технофеодализма, обозреваются отечественные и зарубежные точки зрения в рамках заданной дискуссии, а также приводятся практические примеры проявлений технофеодализма как в России, так и в других странах. Новизна настоящего исследования выражается в комплексном рассмотрении правового положения автора и коммерциализации исключительного права на произведения в условиях технофеодализма. В завершении статьи автором предлагаются возможные направления по решению обозначенных проблем.</p></abstract><abstract xml:lang="en" abstract-type="summary"><p>In this article, the author explores the concept of technofeudalism as a new type of socio-economic relations and its impact on the legal status of the author. The article presents the results of an analysis to determine the nature of the impact of such manifestations of technofeudalism as recommendation algorithms and digital platforms on the commercialization of the exclusive rights of authors of works. The author analyzes the causes of the problems preventing such commercialization in the context of technofeudalism, examines domestic and foreign points of view within the framework of the given discussion, and provides practical examples of manifestations of technofeudalism both in Russia and in other countries. The novelty of this research is expressed in a comprehensive consideration of the legal status of the author and the commercialization of the exclusive right to works in the context of technofeudalism.
