Актуальность исследования обусловлена необходимостью осмысления историко-правовых предпосылок, обусловивших качественный скачок в развитии междуна родного гуманитарного права (далее – МГП) в середине XXвека. Традиционный тезис «Inter arma enim silent leges» («Во времена войны безмолвствуют законы») требует пересмотра в контексте системной кодификации правовых норм, последовавшей за ужасами Второй мировой войны. Целью статьи является комплексный анализ роли Второй мировой войны в качестве ключевого катализатора, определившего содержание и направление развития современ нойсистемы МГП. Для достижения цели решаются следующие задачи: выявить ограничен ность и пробелы системы МГП, существовавшей к 1939 году; документально проиллю стрировать систематический характер наиболее вопиющих нарушений существовавших правовых норм государствами «Оси» на основе исторических и правовых источников; проследить прямую причинно-следственную связь между этими нарушениями и принятием основополагающих международно-правовых актов в послевоенный период. Методологическую основу составляют историко-правовой метод, позволивший реконструировать генезис правовых институтов, и сравнительно-правовой метод, исполь зованный для сопоставления нормативных положений Гаагского и Женевского права с прак тикой их применения и последующего развития. Результаты и научная новизна заключаются в системном доказательстве того, что Вторая мировая война не привела к «безмолвию» права, а, напротив, стала импульсом для его кардинальной трансформации. В работе показано, что именно ответ на беспреце дентные военные преступления и преступления против человечности привел к появлению четырех Женевских конвенций 1949 года, становлению принципа верховенства прав чело века, запрету агрессивной войны в Уставе ООН и созданию прецедента международной уголовной ответственности (Нюрнбергский процесс). Выводы подтверждают центральный тезис: Вторая мировая война выполнила функ циюкатализатора, который актуализировал потребность в более эффективном и универсальном правовом регулировании вооруженных конфликтов, заложив фундамент тойсистемы МГП, которая, несмотря на вызовы, продолжает функционировать сегодня

The relevance of the study is due to the need to understand the historical and legal prerequisites that led to a qualitative leap in the development of international humanitarian law (hereinafter referred to as IHL) in the mid-20th century. The traditional thesis «Inter arma enim silent leges» («In times of war, laws are silent») requires revision in the context of the systematic codifica tion of legal norms following the horrors of the Second World War. The aim of the article is a comprehensive analysis of the role of the Second World War as a keycatalyst that determined the content and direction of the development of the modern IHLsystem. To achieve this aim, the following tasks are set: to identify the limitations and gaps of the IHLsystem that existed by 1939; to document, based on historical and legal sources, the systematic nature of the most egregious violations of the existing legal norms by the Axis states; to trace a direct causal link between these violations and the adoption of fundamental international legal instruments in the post-warperiod. The methodological basis comprises the historical-legal method, which allowed for the recon struction of the genesis of legal institutions, and the comparative-legal method, used to compare the normative provisions of the Hague and Geneva law with the practice of their application and subse quent development. The results and scientific novelty lie in the systematic proof that the Second World War didnotlead to the «silence» of law but, on the contrary, became an impulse for itsradical transformation. The paper demonstrates that it was the response to unprecedented warcrimes and crimes against humanity that led to the crystallization of the four Geneva Conventions of 1949, the establishment of the principle of the supremacy of human rights, the prohibition of aggressive war in the UNCharter, and the creation of a precedent for international criminal responsibility (the Nuremberg Trials). The conclusions confirm the central thesis: the Second World Warserved as a catalyst that highlighted the need for more effective and universal legal regulation of armed conflicts, laying the foundation for the IHLsystem which, despite challenges, continues to function today
