Статья посвящена историко-правовому исследованию трансформации правовых основ режима содержания в исправительно-трудовых лагерях СССР в 1930-е гг. Автор анализирует динамику перехода от кодифицированного законодательства к ведомственному нормотворчеству ОГПУ–НКВД, выделяя ключевые этапы этого процесса. В работе критически рассматриваются нормативные акты периода, включая Положение об ИТЛ 1930 г. и ИТКРСФСР 1933 г., в контексте их вытеснения секретными инструкциями. Обосновывается тезис о фактической декодификации исправительно-трудового права к концу десятилетия. Сделан вывод, что подмена закона производственной целесообразностью привела к деформации правового статуса заключенного, окончательно закрепив за нимстатус «производственной единицы» в рамках мобилизационной экономики

The article is devoted to a historical and legal study of the transformation of the legal foundations of the detention regime in the corrective labor camps (ITL) of the USSR in the 1930s. The author analyzes the dynamics of the transition from codified legislation to the departmental rule-making of the OGPU-NKVD, identifying the keystages of this process. The paper critically examines the regulatory acts of the period, including the Regulations on ITL of 1930 and the Corrective Labor Code of the RSFSR of 1933, in the context of their displacement by secret instructions. The thesis of the actual de-codification of corrective labor law by the end of the decade is substantiated. It is concluded that the substitution of law by production expediency led to a deformation of the legal status of the prisoner, finally establishing the status of a “production unit” within the framework of a mobilization economy
