Статья посвящена эволюции доктринальных представлений о соотно шении государственного суверенитета и права индивида на свободу передвижения в исто рииправовой мысли, это позволило наметить концептуальные модели решения данной проблемы. Эволюция доктринальных представлений о соотношении государственного суверенитета и прав человека в миграционно-правовом поле состоит в постепенном перехо де от естественно-правового обоснования свободы передвижения через позитивистское закрепление суверенного контроля к современной модели суверенитета, сопряженного с обязательствами в сфере защиты прав мигрантов

The article is devoted to the evolution of doctrinal ideas about the relationship between state sovereignty and the individual’s right to freedom of movement in the history of legal thought, from the Spanish scholastics of the 16th century to modern concepts of global migration management, which allowed us to outline conceptual models of the relationship between sovereign ty and freedom of movement. The evolution of doctrinal ideas about the relationship between state sovereignty and human rights in the migration and legal field consists in a gradual transition from the natural legal justification of freedom of movement through the positivist consolidation of sovereign control to the modern model of sovereignty, coupled with obligations in the field of protection of migrants’ rights
